PLEASE READ THESE TERMS OF SERVICE CAREFULLY, AS THEY CONTAIN AN AGREEMENT TO ARBITRATE, CLASS ACTION WAIVERS, LIMITATIONS ON LIABILITY, DISCLAIMERS OF WARRANTIES, AND OTHER IMPORTANT LEGAL INFORMATION THAT AFFECTS YOUR RIGHTS. BY USING OUR SERVICES, YOU AGREE TO THESE TERMS.

1. Acceptance of Terms
   This Terms of Service Agreement (“Agreement”) is a legally binding contract between you (“User,” “Client,” “Customer,” or “Notary”) and Sign Here Ink (“Company,” “we,” “our,” or “us”). By accessing or using our website, services, platform, or network of notaries, you agree to be bound by the terms in this Agreement. If you do not agree, you may not use our services.

2. Company Role and Disclaimer
   Sign Here Ink is a national coordination service that connects clients with independently contracted notaries for the completion of notarizations. Sign Here Ink is not a notary public, law firm, or legal document preparation company. We do not perform notarial acts or provide legal or financial advice. All notarial services are performed by third-party notaries under their respective commissions and state regulations.

We facilitate access to these services by sourcing, managing, and coordinating the deployment of qualified, vetted notaries. Our role is administrative and logistical, and we make no guarantees regarding the legal sufficiency, enforceability, or outcome of any document notarized through our coordinated services.

3. Services Provided
   We provide the following coordination and support services:

• Scheduling of notaries for remote or in-person signings

• Oversight of quality assurance and service standards

• Access to vetted and state-compliant notaries

• Dedicated support for estate planning notarization coordination

• Status tracking and logistics management of appointments

We do NOT provide:

• Legal document preparation (non-attorney support)

• Legal advice or representation

• Live scan fingerprinting services

• Apostille authentication or courier services (unless otherwise stated in a separate agreement)

4. Eligibility and User Requirements
   To use our services, you must:

• Be at least 18 years old and legally capable of entering binding agreements

• Provide accurate, complete, and current information

• Not use our platform or services for any unlawful, fraudulent, or malicious purposes

5. Notary Compliance and Standards (For Notaries)
   Notaries in our network must:

• Hold a valid, active commission in their state

• Provide accurate licensing and E&O insurance documentation

• Follow all relevant state laws and notarial best practices

• Maintain confidentiality, professionalism, and prompt service

• Report any irregularities or concerns immediately

Notaries agree that they are independent contractors and not employees of Sign Here Ink. We do not control or supervise the execution of notarial acts.

6. Client Responsibilities
   Clients are responsible for:

• Ensuring that documents are complete, accurate, and ready for notarization

• Confirming the legal identity and capacity of signers

• Providing timely access to signers and relevant parties

• Adhering to appointment times, and notifying of any changes at least 24 hours in advance

7. Payments and Cancellations
   Service fees are invoiced as agreed. Payment is due upon booking or completion of the signing, depending on the contract. Cancellations within 24 hours of the scheduled appointment may be non-refundable. We reserve the right to charge additional fees for missed appointments, emergency scheduling, wait time, or rescheduling.

8. Non-Solicitation and Exclusivity
   Clients and notaries agree not to engage one another for services outside of Sign Here Ink without prior written authorization for a period of twelve (12) months following the last appointment coordinated. Breach may result in removal from our platform and potential legal action.

9. Privacy and Data Protection
   We respect your privacy and handle all data in accordance with our Privacy Policy. We collect and process limited personal data necessary to provide coordination services and comply with legal obligations. We do not sell, lease, or share personal data with third parties beyond the scope of service fulfillment.

10. Platform Use and Intellectual Property
    All content on our website, including our name, branding, software, scheduling tools, and documentation, is the intellectual property of Sign Here Ink and protected by applicable laws. You may not copy, reproduce, modify, or exploit any of our materials without written consent.

11. Disclaimers

• Services are provided “AS IS” and “AS AVAILABLE.”

• We do not warrant that services will be error-free, uninterrupted, or fit for a particular purpose.

• We are not responsible for legal outcomes resulting from improperly notarized documents, nor liable for notarial errors made by contracted notaries.

12. Limitation of Liability
    To the fullest extent allowed by law, Sign Here Ink will not be liable for any indirect, incidental, punitive, special, or consequential damages arising out of your use of the services, even if we have been advised of the possibility. Our maximum liability shall not exceed the total amount paid for the specific services at issue.

13. Indemnification
    You agree to indemnify and hold Sign Here Ink, its officers, staff, contractors, and affiliates harmless against any claim, demand, loss, liability, or expense (including attorneys’ fees) arising from:

• Your use of our services

• Your breach of this Agreement

• Any fraudulent, negligent, or unlawful conduct by you or those under your direction

14. Dispute Resolution and Binding Arbitration
    You agree to resolve any disputes through binding arbitration under the American Arbitration Association (AAA) rules. You waive the right to a jury trial or to participate in class actions. Arbitration will occur in San Diego County, CA. You may bring a claim in small claims court if it qualifies.

15. Governing Law
    This Agreement is governed by and interpreted according to the laws of the State of California. Any legal action must be brought in San Diego County.

16. Force Majeure
    We are not liable for delays or failures due to causes beyond our control, including but not limited to natural disasters, war, labor disputes, technical failures, or government actions.

17. Modifications
    We reserve the right to modify or update these Terms at any time. Continued use of services after changes implies acceptance. We will post updated versions on our website with the effective date.

18. Severability and Waiver
    If any part of this Agreement is deemed unenforceable, the remainder remains in effect. Our failure to enforce any provision is not a waiver of our rights.

19. Entire Agreement
    These Terms constitute the complete agreement between you and Sign Here Ink, superseding all prior agreements. Additional terms may apply based on individual contracts or service orders.
